Terms Of Use

These Terms of Service (“Terms”) govern your access to and use of the services, websites, and applications offered by (“Go Gamers”) (the “Service”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms.

In addition to the Sites, the mobile application, or a portion thereof, may also be made available via third party websites. If you have accessed the mobile application, or any portion thereof, via a website operated, managed, maintained or controlled by a third party, your use of such website may be subject to terms and conditions imposed by such third party. Go Gamers is not responsible or liable for any terms, conditions, policies, acts or omissions of any such third parties.

YOU AGREE THAT BY USING THE GO GAMERS APPLICATION YOU ARE AT LEAST 18 YEARS OF AGE AND YOU ARE LEGALLY ABLE TO ENTER INTO A CONTRACT. IF YOU ARE BETWEEN 13 AND 18 YEARS OF AGE, YOU MUST HAVE YOUR PARENT OR LEGAL GUARDIAN’S PERMISSIONS TO USE GO GAMERS. YOU MUST NOT ACCESS GO GAMERS OR ACCEPT THESE TERMS IF YOU ARE A PERSON WHO IS EITHER BARRED OR OTHERWISE LEGALLY PROHIBITED FROM RECEIVING OR USING GO GAMERS UNDER THE LAWS OF THE COUNTRY IN WHICH YOU ACCESS OR USE THE SERVICE.

This Agreement sets forth and contains the terms and conditions between you and the Service. By checking the box on the player Sign Up page that indicates that you “have read and agree to the Go Gamers player terms and conditions” and then clicking the “Continue” button to submit the Player registration form, you are entering into this Agreement. You should, therefore, read this Agreement carefully. IF YOU DO NOT AGREE TO BE BOUND BY ANY TERM OF THIS AGREEMENT, DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO THESE TERMS AND CONDITIONS AND DO NOT OTHERWISE CONTINUE WITH THE PLAYER REGISTRATION PROCESS. In such case you will not be able to register as a Player or otherwise use the Listener Platform.

Go Gamers may modify this Agreement or any part hereof at any time in its absolute discretion. Therefore, Player is encouraged to check the terms of this Agreement frequently. By using the Listener Platform or a Site after any modifications to this Agreement have been made, Player agrees to be bound by such modified Agreement.

The website, mobile application and the content made available via the Service. The Service allows Players to directly with content on the Service. Go Gamers, via the website and mobile application, enables a Player to communicate directly with the Service and other Players.

As further described in this Agreement, Go Gamers makes no representation or warranty whatsoever as to (a) the accuracy or availability of the Service, (b) the willingness or ability of the player to help, (c) the willingness or ability of any player to give advice, (d) whether the Player shall find another player’s listening useful or satisfactory, (e) whether the Player shall find another player’s advice relevant, useful, accurate or satisfactory, (f) whether the helping of the player will be helpful, (g) whether the advice of the player will be responsive or relevant to the Player’s question, or (h) whether the player’s advice will otherwise be suitable to the other Player’s needs. Go Gamers does not verify the skills, degrees, qualifications, credentials or background of any players. It is strongly recommended that the Player independently verify the skills, degrees, qualifications, credentials and background of other players from whom he or she receives or contemplates to receive advice or services.

Tournament Rules

This page contains the comprehensive rules governing gameplay and conduct. Whilst we have endeavored to ensure all rules provide adequate guidance to meet all eventualities, instances may occur where teams feel that further guidance is needed. In such an event, contact a member of the GoGamers Admin Team.

The GoGamers tournament administration reserves the right to amend, remove, or otherwise change the rules outlined in this rulebook, without notice. The tournament administration also reserves the right to make judgment on cases that are not specifically supported or detailed in this rulebook, to preserve fair play and sportsmanship. All competitors involved associated with GoGamers are expected to know and understand all of the rules. Not knowing that a rule existed is not an excuse for breaking that rule.

Users are prohibited from sharing account information. This includes, but is not limited to the following: usernames, passwords, gamertags, email accounts, etc. If another person accesses your account, you may be disqualified from the Cup. This includes giving out your password to allow others to account recover your Playstation or Xbox Gamertag.

It is the responsibility of the player to ensure the Gamertag/PSN they use, matches the Gamertag/PSN listed on their GoGamers profile. If a player’s Gamertag/PSN is incorrect, you will be disqualified from the cup.

Prizes are awarded to the 1st placed player only. In order to be eligible for the award, all teams must play their matches in its entirety. If either team withdraw from the competition at any time in the run up to the final, they waive all rights to any prize claims.

Users are not permitted to compete in more than one Cup at a time as this may delay the cup, any team found competing in 2 or more Cups will be disqualified from both tournaments.

Participation in a Cup competition constitutes entrant’s full and unconditional agreement to these Rules, the Official Rules, and Admin decisions, which are final and binding in all matters.

Competition Guidelines

Any rule being broken may lead to disciplinary action. This action will be at the discretion of the Admin(s) involved, and the situation will be taken into account. Punishment may include, but not be limited to, forfeits, replays, penalty points, temporary and permanent bans.

We highly recommend that all players appear offline and set their Friends List to Private during the Cup. However, players are not required to do either of these things.

Any form of cheating, glitching, abusing in-game mechanics, or unsportsmanlike behaviours may result in a forfeit. Punishable unsportsmanlike behaviour includes but is not limited to, excessive use of foul or degrading language. In addition, breaking any rule may result in a forfeit of a Match, Verbal Warning or Ban from GoGamers Events.

GoGamers Staff reserve the right to stream any match in this competition. If your team’s match is chosen, you are to cooperate fully with the staff that are in your match.

Participating Teams must ensure that host testing is done before the start of the Teams Match or Game as they will not be able to submit or alter the score during the game or once the game has begun due to host issues.

Player Entry Eligibility

Players may not be directors, officers, or employees of the Administration or Affiliates, their respective parents, or any of their respective affiliate companies, subsidiaries, agents, professional advisors to the Administration or Affiliates (such as a consultant), advertising and promotional agencies, or immediate family and household members of each.

Participating Player GamerTag shall not include any form of profanity or explicit language

Participating Player must be in set specific age group and not outside of the stated age group. Failure to do so will result in immediate disqualification.

Reporting

Both teams must report the Match results within 5 minutes of its completion.

To report the Match results, teams must report the Series Score accurately, with overall games won being reported. For example, the Match Score can be reported as 3-0, 3-1, etc.

Report scores through the ‘Add my score’ function on your profile page

Both teams must enter the result.

If both teams enter the result differently, a member of the Admin Team will be notified of the discrepancy and will intervene.

Teams found to be deliberately miss entering results may face disciplinary action from the Admin Team.

If a Match is not played, and neither team reports a No Show, both teams will be removed after 30 minutes.

With your camera or phone, take a video or picture after every individual Game in the series screen, then upload it to your preferred video or photo host, send the evidence to the admin dealing with your issue in private message. Another example of strong evidence would be the score with all of the Participating Players with their in game stats at the after game screen.

If a Screenshot(s) or Video(s) is needed in order to resolve a dispute, you must clearly state what the issue is, the time in the video in which the issue occurred, and/or what the GoGamers Staff member should be looking at in the Screenshot/Video. For all cheating claims, the burden of proof is on the accuser.

Code of Conduct
Breach of Etiquette

All teams and players will at all times display good sportsmanship and act in the spirit of the game. Breaches of these rules will be punished with one to six minor penalties, which penalties will be handed out at the sole discretion of the tournament administration. However, the tournament administration may assign penalties for types of unsportsmanlike behaviours (e.g. harassment) that may not be explicitly listed.

Insults

All insults occurring in connection with the tournament will attract penalties or further action. This not only applies to insults during a match but also on the GoGamers website and social media platforms (forums, match comments, player guest books, support and protests, etc.), or any other platform available to the public.

Severe cases of abuse with radical statements or the threat of physical violence can result in significantly heavier penalties including the possibility of the player being disqualified from the tournament. Racial or Religious discrimination will NOT be tolerated and users to be found doing so, will face bans from the website.

Spamming

The excessive posting of senseless, harassing or offensive messages is regarded as spamming. Spamming on the GoGamers website or on GoGamers social media platforms (forums, match comments, player guest books, support and protests, etc.) will attract penalties depending on the nature and severity.

Misconduct

Attempts to mislead tournament administers or other players using false information or any other deceit will be withdrawn from the tournament. Should this happen on more than one occasion, they will face a ban from further events.

Ringing

Any Player found using another Participating Player or Teams account to compete in the tournament other than their own shall be instantly disqualified from the Tournament.

Smurfing

Any player who registers or plays a game, competition or tournament under a smurf, will be disqualified from the tournament.

Cheating

In the event that cheating is uncovered, and at the sole discretion of the GoGamers, the team will be disqualified from the tournament and the player will be banned from all GoGamers competitions for at least two years. These example so cheating include: – Attempts to interfere with any other Participating Player or Team’s connection to the game server or internet service in any form(Also known as DDOSing); – Using an intentional glitch exploitation to gain an advantage over your opposition; – Collusion, Match-fixing, or any other form to change or alter the results of any Game of Match. Collusion include but is not limited to the act of; – An agreement between two (2) or more Participating Players of Teams to alter the outcome of the games; – Pre-arranging to split prize money and/or create any other form of compensation with something other than the Participant’s own Team; – Sending information to the other Participating Players or Teams during the Tournament and throughout a Game/Match, – Deliberately losing a Game or trying to induce another Participating Player or Team to do so.

If you experience acts of this or get contacted by another Party to do so, please contact a GoGamers Tournament Admin straight away through any of our contact means(Section 10).

Non-Disparagement Participants always have the right to express their opinions in a professional and sportsmanlike manner. Disputes or player violation reports must be reviewed by the Administration before any information is released publicly. Participants may not at any time make, post, publish or communicate to any person or entity or in any public forum, false, defamatory, libelous, slanderous or disparaging remarks comments or statements concerning the Administration, Affiliates.

Prizes

All results and final placements are verified by GoGamers staff before prizes are awarded.

Once confirmed, the winner will be awarded the prize.

Points will be updated on the leaderboards automatically after the final game has been completed and GoGamers announces the winner.

GoGamers Staff

GoGamers Staff can be contacted to answer any questions or solve any problems your team may have during a Match.

Verbal and/or written abuse of a GoGamers Staff member will not be tolerated. This includes, but is not limited to: Forum Posts, Private Messages, and network messages. The individual user and/ or team violating this rule will be subject to penalties. All team leaders are responsible for the conduct of the players on the team while interacting with GoGamers Staff and are subject to penalties if a team member becomes abusive towards GoGamers Staff.

GoGamers Staff members have the discretion to make necessary calls to ensure the match is completed successfully. When in a match, the GoGamers Staff member’s decision is final and must be followed. Failure to do so will result in penalties for your team.

Miscellaneous

The rules are open to many different interpretations. The only interpretation, which matters, is the interpretation of the Admin team. We reserve the right to modify the rules at any time. This includes changes due to software updates or releases, and any other change deemed necessary by the league. You must understand that the rules listed are guidelines to try and ensure fair and competitive play, and they will be applied by officials based on the spirit of the game. Teams/Players should check the rules prior to any event to ensure they are compliant. They should also keep an eye on the website, as changes will be announced on the website. You must be familiar with the current rule set.

Tournament Eligibility

Participation in the tournament is open to all people within their respected age group.

Tournament Registration

Participants are all required to have a registered account on the GoGamers website and ensure that they are eligible to participate in the tournament. Failure to do so will result in disqualification and further action may be taken.

User Content

“Content” means any information, text, graphics, or other materials uploaded, downloaded or appearing on the Service. You retain ownership of all Content you submit, post, display, or otherwise make available on the Service.

Disclaimer of Warranty

GO GAMERS DOES NOT REVIEW, ENDORSE, RECOMMEND, VERIFY, EVALUATE, WARRANT OR GUARANTEE THE QUALIFICATIONS, EXPERTISE, CLAIMS OR BACKGROUND OF ANY PLAYER OR ANY OPINION, RESPONSE, ADVICE, PREDICTION, RECOMMENDATION, INFORMATION OR OTHER SERVICE PROVIDED BY ANY PLAYER. NOTHING CONTAINED IN THIS AGREEMENT, ON THE SERVICE, ON ANY SITE, ON ANY THIRD PARTY SITE OR PROVIDED OTHERWISE SHALL BE CONSIDERED AS A REFERRAL, ENDORSEMENT, RECOMMENDATION, VERIFICATION, WARRANTY OR GUARANTEE WITH RESPECT TO (A) ANY PLAYER; (B) THE SERVICE; (C) ANY OPINION, RESPONSE, ADVICE, PREDICTION, RECOMMENDATION, INFORMATION OR OTHER SERVICE PROVIDED BY ANY PLAYER OR OTHERWISE MADE AVAILABLE ON THE SERVICE; OR (D) THE VALIDITY, ACCURACY, AVAILABILITY, COMPLETENESS, SAFETY, LEGALITY, QUALITY OR APPLICABILITY OF ANY CONTENT OR ANYTHING OTHERWISE SAID OR WRITTEN BY ANY PLAYER, INCLUDING ANY BIOGRAPHICAL INFORMATION, QUALIFICATIONS, OR OTHER INFORMATION SPOKEN BY ANY PLAYER OR CONTAINED IN OR MADE AVAILABLE ON THE SERVICE, ANY SITE, ANY BLOG OR ANY OTHER FORUM.

PLAYER ACKNOWLEDGES AND AGREES THAT THE SITES AND SERVICE ARE PROVIDED “AS IS”, AND THEREFORE PLAYER WILL NOT HAVE ANY CLAIM OR DEMAND AGAINST GO GAMERS, ITS AFFILIATES, OR ANY OF THE FOREGOING’S OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS, REPRESENTATIVES OR AGENTS WITH RESPECT TO ANY SITE, THE SERVICE OR ANY PLAYER. THE USE OF A SITE AND THE SERVICE IS AT THE PLAYER’S SOLE RISK. TO THE FULLEST EXTENT OF THE LAW, GO GAMERS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY OR ACCURACY.

GO GAMERS EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES RELATED TO INFORMATION POSTED OR TRANSMITTED BY PLAYERS. IF A PLAYER DECIDES TO RELY ON INFORMATION PROVIDED BY ANOTHER PLAYER, PLAYER MUST EXERCISE A HIGH LEVEL OF CARE. THE PLAYER SHALL NOT HAVE ANY CLAIM OR DEMAND AGAINST GO GAMERS, ITS AFFILIATES, AND/OR ANY OF THE FOREGOING’S OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND/OR AGENTS WITH RESPECT TO ANY SERVICE OR ADVICE PLAYER RECEIVES, USES AND/OR RELIES ON. GO GAMERS WILL NOT BE DEEMED THE PROVIDER OR RECIPIENT OF ANY PLAYER’S SERVICES OR OTHER INFORMATION ACQUIRED THROUGH THE SERVICE OR THE SITES.

GO GAMERS DOES NOT ASSUME, AND WILL NOT BE LIABLE FOR: (1) THE ACCURACY OR AVAILABILITY OF ANY SITE OR THE SERVICE; OR (2) ANY DAMAGES OR INJURY ARISING FROM OR RELATED TO ANY SITE, THE SERVICE AND/OR ANY OPINION, RESPONSE, ADVICE, PREDICTION, RECOMMENDATION, INFORMATION AND/OR OTHER SERVICE PROVIDED OR NOT PROVIDED BY ANY PLAYER

Additional Disclaimers

GO GAMERS WILL NOT BE LIABLE FOR ENFORCING ANY AGREEMENT THAT WAS MADE BETWEEN TWO PLAYERS. PLAYERS WILL BE SOLELY RESPONSIBLE FOR ANY AGREEMENT MADE WITH EACH OTHER.

Player Affirmation, Conduct and Use

By submitting the Player registration form, you, the Player, represent, warrant and agree to the following:

You are at least 16 years of age or a legally organized entity, and that you are authorized to submit a Player registration, or that you are authorized to represent the person who is submitting a Player registration, and that you are authorized to sign the Player registration form on behalf of yourself or on behalf of the person that you represent and bind him or her.

You are solely and fully liable for all conduct, postings and transmissions that are made under your user name and password.

You are solely responsible for verifying other Player’s identity, qualifications, credentials, biographic information, licenses held and other information.

Go Gamers is not involved in any transactions between you and any Player.

Go Gamers is not responsible for verifying the identity, qualifications, credentials, biographic information, licensure, and/or any other information regarding any of the Players.

Player will not interfere with or disrupt, or attempt to interfere with or disrupt, any Go Gamers servers, networks or equipment connected to the Service.

Player will not attempt to gain unauthorized access to any other computer system or network connected to the Service.

Player will not transmit, upload, email, post or otherwise make available through the Service or any Site: (A) any “junk mail”, “spam”, or any other types of unsolicited email or news feed postings; or (B) any unlawful, harassing, libelous, privacy invading, abusive, threatening, defamatory, vulgar, obscene, racist, harmful, or otherwise objectionable material of any kind.

Player will not disobey or breach this Agreement or any other applicable agreements or instructions conveyed by Go Gamers.

Player will not violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code.

Player will not transmit, upload, email, post or otherwise make available: (A) any information or material that infringes upon a third party right, especially intellectual property rights; (B) any third party advertisements, including banner exchange services; (C) any software viruses, Trojan horses, worms or any other malicious application or code; or (D) any information or material which may constitute or encourage conduct that is a criminal offense or civil wrong or otherwise violates any applicable law.

Go Gamers may enable the transfer of files between Players. When opening such file attachments received from one Player it is the Player’s responsibility to scan them with an anti-virus software application prior to opening them.

Player will not impersonate any person or entity, or make any false statement regarding his or her employment, agency or affiliation with any person or entity.

Player will not stalk, threaten or harass any Player or infringe upon or attempt to infringe upon their privacy.

Go Gamers may elect, but is not required, to review the Player’s personal profile and amend any typing or spelling errors. Go Gamers does not examine the validity or accuracy of the details in the Player’s personal profile or in any of the Player’s postings or transmissions. Without derogating from the above or any other term of this Agreement, Go Gamers may, in its absolute discretion, refuse to post, transmit or remove any content uploaded by the Player and/or remove any content violating this Agreement. The Player will bear all the risks associated with the uploading and transmitting of material while utilizing the Services, including reliance on its accuracy, reliability or legality.

Proprietary Rights

All right, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of Go Gamers and its licensors. Except as expressly provided herein, nothing in the Terms gives you a right to use the Go Gamers name or any of the logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.

The Service may include advertisements, which may be targeted to the Content or information on the Service, queries made through the Service, or other information. The types and extent of advertising by Go Gamers on the Service are subject to change. In consideration for Go Gamers granting you access to and use of the Service, you agree that Quora and its third party providers and partners may place such advertising on the Service or in connection with the display of Content or information from the Service whether submitted by you or others.

Copyright Policy

Go Gamers respects the intellectual property rights of others and expects users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide our copyright agent with the following information in accordance with the Digital Millennium Copyright Act: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Go Gamers values your privacy. Please review our Privacy Policy to learn more about how we collect and use information about you via the Service. By using the Service you consent to the transfer of your information to India for storage, processing and use by Go Gamers in accordance with our Privacy Policy.

You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Go Gamers of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

Disclaimers; Indemnity

Your access to and use of the Service or any Content is at your own risk. You understand and agree that the Service is provided to you on an “AS IS” and “AS AVAILABLE” basis. Without limiting the foregoing, GO GAMERS AND ITS PARTNERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Service or any content thereon. Go Gamers will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Service, or any Content. You also agree that Go Gamers has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Service. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from Go Gamers or through the Service, will create any warranty not expressly made herein.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GO GAMERS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT GO GAMERS HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

If anyone brings a claim against us related to your actions or Content on the Service, or actions or Content by or from someone using your account, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
